PRIVACY POLICY

This Privacy Policy explains how Fitadel Fitness Games, operated by JavenMorrisLLC (“Fitadel Fitness Games,” “Gritspire,” “JavenMorrisLLC,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects information through fitnessrpg.com, the Gritspire web or mobile application, campaigns, guilds, assessments, coaching and training offerings, certification programs, events, direct messages, SMS program, and related services.

Gritspire is Fitadel Fitness Games’ flagship fitness role-playing game. References to “Gritspire,” “Fitadel Fitness Games,” or “the Services” include the Gritspire game and the related websites, applications, programs, features, and services operated by JavenMorrisLLC.

1. Information collected — Depending on how the Services are used, Fitadel Fitness Games may collect:

• Identity and contact information: name, username, email address, phone number, postal address, age or age range, and account identifiers.

• Account and profile information: password credentials or authentication identifiers, character name, avatar, guild, campaign, preferences, settings, and communication choices.

• Fitness and training information: goals, experience level, activity selections, assessment results, movement or performance information, training progress, check-ins, injuries or limitations that a user voluntarily reports, and coaching or certification records.

• Content and communications: direct messages, support requests, comments, reflections, reviews, photos, videos, survey responses, and user content.

• Transaction information: purchases, subscriptions, enrollment records, refund information, and limited payment-status information.

• Payment-card details are generally processed by third-party payment providers rather than stored by Fitadel Fitness Games.

• Technical and usage information: IP address, browser or device type, operating system, app version, approximate location inferred from IP, pages or screens viewed, links clicked, dates and times of access, campaign activity, guild activity, crash information, and cookie or similar identifiers.

• SMS and call information: mobile number, opt-in or opt-out status, consent date and source, messages sent and received, delivery status, carrier or messaging metadata, support history, and call-related preference or consent records.

• Information from others or integrations: information provided by a parent, guardian, coach, administrator, referral source, payment provider, app store, authentication provider, wearable or fitness integration, or other authorized service.

Please do not submit sensitive health information unless it is needed for a feature and the submission channel is appropriate. Fitadel Fitness Games does not need diagnoses, medical records, or detailed clinical information to provide ordinary game or training features.

2. How information is used — Fitadel Fitness Games may use information to:

• Create and administer accounts, Gritspire campaigns, guilds, profiles, assessments, coaching, training, certification, and other Services.

• Deliver requested content, reminders, support, direct messages, SMS messages, and service communications.

• Send recurring SMS messages after inactivity, including approximately 48-hour, 72-hour, or extended guild-inactivity triggers, when the user has separately opted in.

• Contact a user by phone when the user has provided the applicable call consent or where a non-promotional service call is otherwise permitted, including to invite the user back to a Gritspire campaign, check on training progress, answer questions, or provide support.

• Personalize Gritspire progression, training suggestions, campaign experiences, guild experiences, and communications.

• Process payments, subscriptions, registrations, refunds, certificates, and customer-service requests.

• Operate, maintain, troubleshoot, secure, moderate, and improve the Services.

• Measure engagement, diagnose errors, understand feature use, and develop new offerings.

• Prevent fraud, abuse, unauthorized access, harassment, and violations of applicable terms.

• Comply with legal obligations, respond to lawful requests, enforce agreements, and protect rights, safety, and property.

• Send marketing or promotional communications only where permitted and with any consent required by law. SMS marketing or re-engagement messages will not be sent unless covered by the applicable SMS consent.

Fitadel Fitness Games does not make decisions about a person’s eligibility for employment, housing, credit, insurance, healthcare, or government benefits based solely on Gritspire assessment or game information.

3. SMS privacy and consent — SMS opt-in information and consent will be used to operate the Fitadel Fitness Games SMS program, including sending the message categories described at enrollment, managing preferences, responding to HELP requests, processing STOP requests, preventing abuse, and maintaining compliance records. No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. SMS opt-in data, consent records, and text-message consent will not be sold, rented, or shared with third parties for their own marketing. Fitadel Fitness Games may disclose this information to service providers that send, route, store, secure, moderate, or support messages, but those providers may use it only to provide services to Fitadel Fitness Games and as permitted by contract and law. Users may revoke SMS consent at any time by replying STOP or another recognized opt-out phrase, contacting javenmorris.fit@gmail.com or 385-539-9995, or using account settings. A one-time confirmation of an opt-out may be sent where permitted, but it will not contain promotional content. Opting out of SMS does not automatically delete the account or erase information that Fitadel Fitness Games must retain for legal, security, accounting, dispute, or compliance purposes.

4. Direct messages and user content — Fitadel Fitness Games processes direct messages, support conversations, and user content to deliver requested communication or community features, provide support, moderate abuse, protect users, troubleshoot, and comply with law. Do not send emergency requests, passwords, payment-card data, government identification, or unnecessary sensitive health information through direct messages. Direct messages and user content may be accessible to authorized personnel, contractors, coaches, moderators, or service providers who need access to operate, secure, support, or moderate the Services. Fitadel Fitness Games may disclose content when reasonably necessary to investigate threats, fraud, abuse, safety issues, legal violations, or legal requests.

5. How information is shared — Fitadel Fitness Games may share information with:

• Service providers and processors for hosting, databases, authentication, analytics, email, SMS, customer support, payments, security, moderation, scheduling, automation, and technical operations.

• Coaches, instructors, moderators, guild leaders, or administrators when needed for a feature, program, campaign, guild, coaching relationship, event, or support request.

• Access should be limited to information relevant to their role.

• Payment processors and app stores to complete purchases, subscriptions, refunds, and app distribution.

• Professional advisors such as attorneys, accountants, insurers, auditors, and security consultants under appropriate confidentiality obligations.

• Authorities or other parties when required by law, legal process, court order, or governmental request, or when reasonably necessary to protect users, the public, Fitadel Fitness Games, JavenMorrisLLC, or another person.

• Business-transfer parties in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, subject to applicable law and reasonable protections.

• With consent or at the user’s direction, including when a user chooses to join a guild, share a profile, participate in a challenge, connect an integration, or request support.

Fitadel Fitness Games does not sell personal information or share mobile-number, SMS opt-in, or SMS consent information for another party’s independent marketing. Service providers may process information only to provide contracted services, not to build their own marketing lists from Fitadel Fitness Games SMS consent.

6. Cookies and analytics — Fitadel Fitness Games and its service providers may use cookies, local storage, pixels, SDKs, logs, and similar technologies to keep users signed in, remember settings, understand usage, secure the Services, measure performance, and improve features. Browser or device settings may limit some technologies, but doing so may impair functionality. Where required, Fitadel Fitness Games will provide applicable cookie choices or consent controls.

7. Data retention — Fitadel Fitness Games retains information for as long as reasonably necessary to provide the Services, maintain account and training history, administer purchases and certifications, honor communication preferences, resolve disputes, enforce agreements, prevent abuse, satisfy accounting or legal obligations, and maintain security or backup systems. Retention periods vary by data type and purpose. When information is no longer needed, Fitadel Fitness Games may delete it, de-identify it, aggregate it, or securely dispose of it, subject to legal requirements, backup cycles, unresolved disputes, fraud-prevention needs, and legitimate operational interests. SMS opt-in and opt-out records may be retained after an opt-out to document compliance and prevent unwanted re-enrollment.

8. Security — Fitadel Fitness Games uses reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information, such as access controls, authentication, vendor controls, logging, secure configuration, and reasonable protection of data in transit and at rest where supported by the applicable system. No online service can guarantee absolute security. Users should use strong, unique credentials and promptly report suspected unauthorized access to javenmorris.fit@gmail.com.

9. Children — The Services are not directed to children under 13, and Fitadel Fitness Games does not knowingly collect personal information from children under 13 without legally required authorization. Where a family or youth feature is offered, a parent or legal guardian must manage consent and participation as required by applicable law. If a parent or guardian believes a child has provided information improperly, contact javenmorris.fit@gmail.com so the information can be reviewed and deleted where appropriate.

10. Your choices and rights — Depending on location and applicable law, users may have the right to request access to, correction of, deletion of, or a copy of personal information; withdraw consent; opt out of marketing; manage cookies; restrict certain processing; or appeal a privacy decision. Users may also manage account, guild, profile, direct-message, email, SMS, and call preferences through available settings or by contacting javenmorris.fit@gmail.com. To make a request, contact javenmorris.fit@gmail.com with the account name, email, phone number, request type, and any information reasonably needed to verify identity. Fitadel Fitness Games may request additional verification and may deny or limit a request where permitted by law, including when fulfilling it would compromise security, another person’s privacy, legal obligations, or the integrity of the Services. An authorized agent may submit a request where legally permitted and where authorization can be verified.

11. U.S. state privacy notices — Residents of states with applicable comprehensive privacy laws may have additional rights. The scope of those rights depends on the user’s state, the information involved, and whether an exemption or threshold applies. Fitadel Fitness Games will process qualifying requests in accordance with applicable law. Contact javenmorris.fit@gmail.com to exercise a state-law right or ask about an appeal process. If Fitadel Fitness Games later engages in targeted advertising, sale of personal information, or profiling that creates additional legal obligations, this Policy will be updated and applicable opt-out mechanisms will be provided. Do not claim that such processing occurs unless it actually does.

12. Health-related information — Fitadel Fitness Games may receive information about goals, exercise, movement, limitations, assessments, and training progress. Fitadel Fitness Games is not necessarily a HIPAA-covered entity or business associate, and the Services are not represented as a HIPAA-regulated medical record. Some health-related apps may be subject to the FTC Health Breach Notification Rule or other privacy obligations, including breach-notification requirements for certain unsecured identifiable health information. Fitadel Fitness Games will not use or disclose health-related information in a manner inconsistent with promises made in this Policy or applicable law. Users should provide only information reasonably necessary for the feature being used.

13. International users — The Services are operated from the United States and may be processed in the United States or other countries where Fitadel Fitness Games, JavenMorrisLLC, or its service providers operate. Those locations may have privacy protections different from the user’s home country. Users outside the United States should use the Services only where permitted and contact javenmorris.fit@gmail.com with questions about applicable rights.

14. Third-party links and services — The Services may contain links, integrations, or embedded features operated by third parties. Their privacy practices are controlled by their own policies, not this Policy. Review third-party policies before providing information or enabling an integration. Fitadel Fitness Games is not responsible for third-party privacy or security practices except as required by law.

15. Changes to this Policy — Fitadel Fitness Games may update this Policy when practices, technology, legal requirements, or Services change. The updated version will be posted with a new “Last updated” date. Material changes may also be communicated through the Services, email, or another reasonable method. Continued use after the effective date means the updated Policy applies to future processing, to the extent permitted by law.
