TERMS & CONDITIONS

1. Agreement — These Terms & Conditions (“Terms”) govern access to and use of fitnessrpg.com, the Fitadel Fitness Games web or mobile application, related software, programs, coaching, training materials, guilds, campaigns, assessments, certifications, events, messaging features, and other services provided by JavenMorrisLLC (“Fitadel Fitness Games,” “Company,” “we,” “us,” or “our”). By creating an account, accessing the Services, purchasing an offering, joining a campaign or guild, submitting information, or using any messaging feature, the user (“you” or “your”) agrees to these Terms and the Privacy Policy. If you do not agree, do not use the Services. If you use the Services for a business, family, team, or organization, you represent that you have authority to accept these Terms for that group and are responsible for its users.

2. Eligibility and accounts — You must provide accurate information and keep it current. You are responsible for protecting login credentials, maintaining the security of your account, and all activity occurring through the account. Notify javenmorris.fit@gmail.com promptly if you believe an account has been accessed without permission. The Services are intended for users who can legally agree to these Terms. Users under the age of 18 may use the Services only with the involvement and consent of a parent or legal guardian, where permitted. A parent or guardian is responsible for the minor’s use, submissions, safety, and compliance with these Terms. Do not create an account for another person without authorization, impersonate another person, use a disposable or unauthorized phone number, or provide a number that does not belong to you or that you are not authorized to use.

3. Description of the Services — Fitadel Fitness Games combines movement training, fitness education, assessments, game mechanics, campaigns, guilds, progress tracking, storytelling, coaching, and community features. Features may include movement categories, character or stat progression, training sessions, quests, reminders, reflections, direct messages, guild activity, assessments, and educational content. The Services may change over time. We may add, modify, suspend, or discontinue features, content, programs, campaigns, guilds, or communication methods, subject to applicable law and any express terms of a paid order.

4. Fitness and health disclaimer — The Services provide general fitness, movement, educational, and entertainment information. They are not medical care, physical therapy, diagnosis, treatment, emergency services, or individualized medical advice. No coach, instructor, employee, contractor, community member, message, assessment, score, recommendation, or program creates a physician-patient, therapist-patient, or other healthcare-provider relationship. Consult a qualified healthcare professional before beginning or changing exercise, especially if you have a medical condition, injury, pain, pregnancy, recent surgery, disability, or concern about your ability to exercise. Stop immediately and seek appropriate medical attention for chest pain, severe shortness of breath, fainting, unusual dizziness, acute pain, or other concerning symptoms. Never use the Services for emergencies. You are responsible for selecting appropriate activities, difficulty, equipment, location, supervision, and modifications. Exercise involves inherent risks, including soreness, falls, strains, sprains, aggravation of existing conditions, serious injury, disability, or death. To the maximum extent permitted by law, you voluntarily assume those risks.

5. Assessments, coaching, and certifications — Any assessment, score, stat, level, badge, recommendation, or progress indicator is a product feature and educational aid, not a medical evaluation, diagnosis, guarantee of performance, or guarantee of safety. Results may be affected by self-reported information, testing conditions, measurement limitations, device limitations, and technical errors. Coaching, instructor training, or certification offerings—if provided—do not authorize a person to diagnose, treat, rehabilitate, prescribe medical care, or represent that Fitadel Fitness Games is a government regulator, accredited healthcare institution, or accredited educational institution unless expressly stated in a written agreement. Certification requirements, renewal rules, scope, and restrictions are governed by the applicable program materials or enrollment agreement.

6. User content and community conduct — The Services may allow users to post profiles, messages, comments, images, videos, training notes, questions, reviews, guild content, and other material (“User Content”). You retain ownership of User Content, but grant Fitadel Fitness Games a worldwide, nonexclusive, royalty-free license to host, store, reproduce, display, transmit, format, adapt, and use it as reasonably necessary to operate, secure, improve, and promote the Services, subject to the Privacy Policy and any settings or permissions presented at submission. You are responsible for User Content and must have all rights and permissions needed to submit it. Do not submit another person’s health, contact, image, or personal information without appropriate permission. You may not use the Services to: Harass, threaten, stalk, bully, exploit, or discriminate against another person. Share sexually explicit, hateful, violent, unlawful, fraudulent, or malicious material. Give medical, emergency, or dangerous exercise instructions while misrepresenting qualifications. Encourage unsafe challenges, reckless conduct, or exercise despite warning signs. Upload malware, scrape data, reverse engineer the Services, or interfere with security. Use bots, automation, or bulk messaging without written authorization. Infringe intellectual-property, privacy, publicity, or other rights. Collect or export phone numbers, messages, or user information for unauthorized purposes. Fitadel Fitness Games may remove content, limit visibility, restrict messaging, suspend guild access, or terminate accounts when it reasonably believes that content or conduct violates these Terms, creates risk, or harms the community.

7. Direct messaging and communications — Direct messages may be available for support, coaching, campaign coordination, guild interaction, onboarding, accountability, or other Service functions. Do not use direct messaging for emergencies. Messages may be reviewed, retained, filtered, moderated, or disclosed as described in the Privacy Policy and as permitted or required by law. Users should not expect communications to be instantaneous, confidential like a medical record, or continuously monitored. Do not send payment-card information, passwords, government identification numbers, or highly sensitive health information through direct messages unless specifically requested through an approved secure process.

8. SMS program terms — These SMS Program Terms apply when you opt in to receive text messages from Fitadel Fitness Games. Program name and sender: The program is called Fitadel Fitness Games SMS and is operated by JavenMorrisLLC. Messages may originate from 385-539-9995 or other numbers disclosed during enrollment or permitted by the messaging provider. Message purposes: Messages may include account and campaign reminders, training check-ins, progress questions, support responses, guild-activity notices, re-engagement messages following inactivity, invitations to return to a campaign, and other messages reasonably related to the Services you requested. A message may be sent after approximately 48 hours or 72 hours of inactivity, or after an extended period of inactivity with a guild. Actual timing may vary because of time zones, system processing, user settings, campaign status, and service availability. Fitadel Fitness Games may use automated workflows to send these messages. Fitadel Fitness Games may also use the phone number to make a personal call about your account, campaign participation, training progress, questions, or an invitation to return, but only as described in the applicable call-consent disclosure and subject to applicable law. Frequency and charges: Message frequency varies. There is no guaranteed number of messages. Message and data rates may apply depending on the mobile plan. Fitadel Fitness Games does not control charges imposed by a carrier. Opt-out: Reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to an incoming message to request that Fitadel Fitness Games stop future SMS messages. You may also opt out by contacting javenmorris.fit@gmail.com, 385-539-9995, or using the account communication settings. Fitadel Fitness Games will process opt-out requests within a reasonable time and will not send further consent-based automated messages except a permitted confirmation or a message necessary to process the request. If you opt out of SMS, you may still receive essential account notices through other channels where permitted, and you may still use the Services unless SMS is expressly required for a particular feature. You may separately withdraw consent to phone calls by contacting javenmorris.fit@gmail.com or 385-539-9995. Help: Reply HELP for help, or contact javenmorris.fit@gmail.com or 385-539-9995. For carrier-related support, contact your wireless provider. Rejoining: To rejoin after opting out, use the available account opt-in flow or reply START if the system supports that keyword. Rejoining requires a new affirmative opt-in and does not occur automatically. No transfer of consent: Your consent applies only to Fitadel Fitness Games’s SMS program and may not be sold, assigned, or transferred to another sender or campaign. Consent is not a condition of purchasing goods or services.

9. Purchases, subscriptions, and refunds — Prices, billing periods, renewal terms, taxes, refund rules, and cancellation procedures will be shown at checkout or in the applicable order, subscription, or enrollment agreement. If a subscription renews automatically, the renewal amount, frequency, and cancellation method will be disclosed before purchase as required by law. You authorize the applicable payment processor to charge the selected payment method for approved purchases and recurring charges. Keep payment information current. A refund or cancellation does not automatically delete an account or withdraw SMS consent; those are separate settings.

10. Intellectual property — The Services, including software, code, interfaces, names, logos, game systems, campaign structures, story elements, artwork, text, videos, audio, assessments, training materials, badges, and compilations, are owned by or licensed to Fitadel Fitness Games and protected by intellectual-property laws. These Terms grant a limited, revocable, nontransferable license to use the Services for personal, noncommercial purposes or for the purpose expressly authorized in writing. You may not copy, sell, sublicense, publish, distribute, modify, create derivative works from, scrape, frame, reverse engineer, or commercially exploit the Services or any protected content without written permission. Feedback may be used by Fitadel Fitness Games without compensation or obligation, provided it does not identify you in a way prohibited by the Privacy Policy.

11. Third-party services — The Services may link to or integrate with payment processors, hosting providers, analytics services, authentication providers, messaging providers, app stores, social platforms, wearable or fitness tools, and other third parties. Third-party services are governed by their own terms and privacy policies. Fitadel Fitness Games is not responsible for third-party availability, security, content, fees, or practices, except as required by law.

12. Disclaimers — To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, noninfringement, or uninterrupted operation. Fitadel Fitness Games does not guarantee specific fitness, health, business, athletic, social, or game outcomes; continuous access; error-free content; or that every exercise or recommendation is appropriate for every person. Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded.

13. Limitation of liability — To the maximum extent permitted by law, Fitadel Fitness Games and its owners, officers, employees, contractors, coaches, instructors, affiliates, licensors, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to the Services, exercise participation, communications, User Content, third-party services, or these Terms. To the maximum extent permitted by law, the total liability for claims relating to the Services will not exceed the greater of the amount paid to Fitadel Fitness Games for the specific Service giving rise to the claim during the six months before the event, or $100. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

14. Indemnification — To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Fitadel Fitness Games and its affiliates, personnel, contractors, coaches, instructors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses—including reasonable attorneys’ fees—arising from your User Content, misuse of the Services, violation of these Terms, violation of another person’s rights, or negligent or wrongful conduct.

15. Suspension and termination — You may stop using the Services or request account closure by contacting javenmorris.fit@gmail.com. Fitadel Fitness Games may suspend or terminate access for violation of these Terms, legal or security concerns, nonpayment, harmful conduct, misuse of communications, or operational reasons. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, dispute provisions, and privacy-related obligations—will survive.

16. Disputes and governing law — These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, unless applicable law requires otherwise. Before filing a formal claim, the parties agree to attempt good-faith informal resolution by sending written notice to javenmorris.fit@gmail.com describing the issue and requested resolution. The parties will allow at least 30 days for informal resolution unless a shorter period is required by law. Optional arbitration provision: Do not publish an arbitration, class-action waiver, or jury-trial waiver unless it has been reviewed and approved by counsel and implemented in a legally enforceable manner.

17. Changes — Fitadel Fitness Games may update these Terms by posting a revised version and changing the “Last updated” date. Material changes may also be communicated through the Services or by email where appropriate. Continued use after the effective date means acceptance of the revised Terms, to the extent permitted by law.
